"ANY FIVE-YEAR OLD CHILD skilled at making mud pies could have done as well," was the opinion of many passersby who observed the repair work done at the edge of Highway 3 in Belfair by men and equipment sent by the Washington State Highway Department last week. Here Ernie Aries, owner of Belfair Hardware which is across from the repair job, wonders how many tax dollars were spent for the work. IT ALL STARTED ON APRIL 4 when the alcove picture and caption appeared in the Huckleberry Herald following completion of a repair job of the edge of Highway 3 in front of the Belfair Builders' cabins in Belfair. On May 17 the letter to the editor from V. W. Korf, district engineer of the State Highway Department, was printed in the Herald objecting to the implied criticism of the caption and explaining why the highway department should not spend tax dollars on jobs which were the responsibility of private property owners. On Wednesday of last week a highway department grader showed up (picture on right) at the very site pictured in last spring's photo and spent about one hour leveling and smoothing the ground to get rid of the water-gathering chuckholes. Curious observers began dropping into the Herald office to find out how come the job was being done after all; had the State Highway Department's policy changed? Could private property owners now have use of highway equipment for work on private property and, if so, where could they call to have something done for them? Or was it more than a coincidence that Belfair Builders had been sold two weeks earlier to a corporation of which a state highway commissioner was part owner? So the editor began digging to find the answers. Details are in the accompanying story, but co~ct~ior~ renched by the editor is that highway commissioner Ike Parker did not misuse his authority as commissioner, the work SHOULD HAVE BEEN DONE by the highway department in the first place so he was not getting something he did not deserve just because of his position. But another conclusion was that an average citizen has to try a lot harder, sometimes unsuccessfully, than a commissioner to get what is due him. The caption indicated "ANY t:IVE YEAR OLD CHILD skilled at making mud pies could have done as well .... " The picture actually portrayed a typical problem in Belfair and elsewhere where business activities occur along a state highway. We tell all business operators we will maintain the highway out to the edge of the shoulder and no farther as to do so would be using tax money for private purposes. In places such as portrayed the local business man has decided not to pave the approach to his property from the shoulder. This creates chuckholes in the approach, especially near t he shoulder which cause the shoulder to break off We occasionally repair these breaks in the edge of the shoulder which occur because the local husiness man does not maintain his .approach or even better, pave it. If the breaks weren't repaired they would gradually work their way further into the shoulder and pavement area. Wc believe the motorist deserves a relatively smooth surface to drive on. District I'ngineer By LOU DONNELL A lot of my time was spent on streets and highways last week after several persons came into the office to ask questions I couldn't answer. On Wednesday when a state highway department grader began leveling the land adjacent to the highway in front of the Belfair Home Center cabins, the same land pictured in the paper last April as needing work which brought forth a letter from the district engineer of the highway department stating that it was up to the property owner to level it, three people questioned why, all of a sudden, the work was being done. The letter, published in May, had been specific: "We tell all business operators we will maintain the highway out to the edge of the shoulder and no farther as to do so would be using tax money for private purposes.'" The persons asking the questions knew that the business had changed hands two weeks earlier and one of the new owners was a member of the state highway commission. Was he using tax money to pay for work he should pay himself was the implied question. I tried calling Mr. Korf, the district engineer, whose office is in Tumwater and Hans Frankmoelle, maintenance engineer for this area, whose office is in Gorst, but both were out and 1 was told they would call me back later in the afternoon. Mr. Korf was the first to call and I asked if the policy had changed; he assured me it had not. When I asked why the work was being done, it was obvious he did not know anything about the work done that day, but when I explained the concern of several people in the area about whether a highway commissioner was using his position to get work done that shouldn't be done, he agreed the question needed answering and promised to find out and call me back. At lunchtime I had run into Kathy Landram, whose husband had owned the property in question when the picture had been taken in April. She said that she had been told that, although the chuckholes pictured above were on state highway right-of-way, property owners were responsible for maintaining it, just as homeowners in cities like Seattle must maintain parking strips and sidewalks in front of their homes, although they belong to the city. However, she said, Belfair Builders had leveled and graded the land in question and everything had been fine until the state highway department had issued several permits to utility companies to dig along the edge of the highway to lay lines and no one had inspected the work to make sure the companies had put the land back the way it was before the digging projects. She felt this was the responsibility of the highway department inspectors and when I mentioned this to Korf, he agreed that this should have been done. He called back after talking to Frankmoelle and told me the job was done that morning as routine shoulder repair. When 1 asked why it was routine shoulder repair work now, when he had written that it was not the highway department's responsibility last spring, he said he was not on the scene and couldn't comment, that perhaps the man in his office hadn't correctly analyzed the situation last spring. Mr. Frankmoelle called soon after the confirmed that it is a fact that property owners have to keep up the maintenance of property up to the edge of the pavement. "What happened here," he said, "was that after the last rain I was out in Belfair checking on the new intersection project and I saw chuckholes developing along the edge of the highway in front of the cabins so in order to keep them from getting worse and possibly cracking the highway, I sent the grader out to level the area next to the pavement" 'What do you mean developing?'" 1 asked. "The chuckholes have been there all along and show up clearly in the picture taken last spring just a couple of days after your crew had been out here." "To the best of my knowledge," he replied, "the foreman said there was too much water to do more work at that time." 1 then went across the street to talk to Nell Werner, manager and one of the new owners of the business, and he told me he had called Frankmoelle to ask him to come out and look at the land in question, that his business partner, lke Parker, highway commissioner, had suggested Frankmoelle as the man to contact, that he had mentioned that Parker had suggested he call him but that he had not mentioned that Parker was one of the owners of the business. Belfair Home Center plans to asphalt the entire area in front of the cabins next spring, he said, and they wanted the drainage problem taken care of before they did the work. It should be pointed out that the highway department did not grade the chuckholes adjacent to the highway on the access driveway of the business. Both Korf and Frankmoelle declared they have never had a call from Parker requesting the department to do anything and I found out that when Parker became highway commissioner he gave strict orders to employees of his Bremerton lumber company that they were not to sell anything to the highway department. Frankmoelle confirmed this, saying his department had been asked not to do business there although they never had done too much. My conclusion, after all my conversations, was that the work was not a special privilege given to a business because one of the owners is a highway commissioner, but that the repair job was needed because, of poor inspection of the site after utility companies had torn up the ground and not put it back in the proper shape. I think use of Parker's name carried weight, but it would have done the same if some other businessman had asked him who should be called to get needed work done and he had mentioned that Parker had suggested he call Frankmoelle. I have an idea Parker did not know about previous efforts to have the work done, he was just suggesting a call be made for something he had a right as a citizen to expect, and I imagine he will be embarrassed over the fuss created by the simple job. Frankmoelle came to Belfair the following day and I asked him some questions about the intersection project currently being done at the north end of town. lasked if the highway was going to have asphalt put across the entire width before the job was done, but he said there were not enough funds allocated for that. He agreed the new and old lines, both showing so clearly on the highway, was confusing but said no good product for covering old lines had been found. He also answered one complaint I have heard from many; it is no longer illegal to make left turns across double lines (since May 1972) so persons coming from the north who wish to turn into Belfair Tavern can do so without breaking a law. He said the old entrance to Old Belfair Highway from Highway 3, coming from the south, would be cut off shortly, as soon as motorists got acquainted with the changes already made. He said a curb would be installed to keep traffic from cutting through and landscaping would be done, probably in cooperation with Evergre,~a Garden Club. A little more time was spent last week on the problem of Belfair Street. A man had come into the office recently, asking that I find out if something could be done to make it more obvious that it was a street, not just an extension of the shopping center parking lot. County Commissioner Martin Auseth accompanied me to the site and agreed that a yellow line down the center might be a good idea and maybe some sort of curbing to prevent cars from entering the street all along the parking lot. One entrance and one exit would help designate the short county-owned street as a street. He agreed to have the engineer look the situation over.
